ANNEXURE A : LIMITS OF THE WORKSHOP SESSIONS
Participants need to know the law of the land where they are recording video material. At many points in our workshops we will discuss issues of law, morality and safety regarding various aspects of making videos. The participants mission agency and regional team leaders are best placed to keep participants up to date with the current law as it applies to their situation and unique circumstances. Laws and best practice can change quickly. Everyone needs to know their limits. Move You Media is not permitted to, and does not, provide legal advice. That’s its limit. It does not know the current law or the evolving law in the land in every context. In many countries there are different laws for various aspects in each region and state. In the mix of the various considerations are intellectual property (including copyright), privacy laws, trespass laws and consent. These courses are run out of Sydney Australia where there are great freedoms around anything recorded in public places. However, for example, secret audio recordings (listening devices) are not permitted in Australia and the use of a third party’s intellectual property (which includes literary, dramatic, musical and artistic works) requires the written consent of that party. Generally, it is permitted for people to record their own stories for personal use. Issues arise when you move onto private property. In Australia, generally, there is an implied right of access, unless you are asked to leave, or advised you are trespassing. This freedom is not the same everywhere in the world. So, in regards to all aspects of these legal issues, Move You Media suggests you seek advice from your agency with any specific legal questions.
